Terms of Service

GlassPatch LLC (“GlassPatch,” “we,” “us,” “our”)
1.Acceptance of the Terms
These Terms of Service (“Terms”) are entered into by and between you (“you,” “Customer”) and GlassPatch LLC. These Terms, together with our Privacy Policy and any additional terms presented during booking, payment, authorization, or service (collectively, the “Agreement”), govern your access to and use of our website, booking tools, communications (including SMS), and windshield repair services (collectively, the “Services”).
By requesting a quote, booking an appointment, authorizing work, submitting payment, or otherwise using the Services, you accept and agree to be bound by this Agreement.
2.Changes to the Terms
We may revise these Terms at any time in our sole discretion. Changes are effective when posted and apply to future use of the Services.
3.Privacy
All information collected or provided is governed by our Privacy Policy. By using the Services, you consent to our collection and use of information in accordance with that policy.
4.Scope of Services (Repair-Only)
GlassPatch provides windshield chip repair and limited crack repair where feasible and may offer optional glass treatments. GlassPatch does not perform windshield replacement services.
We may decline service if damage is unsuitable, unsafe, impractical, or if conditions prevent proper repair.
No Replacement Authorization: GlassPatch is not authorized to approve, arrange, or contract for windshield replacement on behalf of the Customer.
5.Estimates, Quotes, and Final Pricing
Estimates may be provided based on photos or descriptions. Final pricing is determined after in-person inspection and may change based on damage size, depth, location, contamination, prior repairs, or structural complexity.
6.Customer Responsibilities
You represent and agree that:
- You are the vehicle owner or authorized to approve service
- All information provided is accurate and complete
- The vehicle is legally parked and accessible
- The work location is safe and lawful
7.Mobile Service Conditions; Right to Refuse or Stop Work
Services are performed at a location you choose. GlassPatch may refuse, pause, or stop work due to unsafe conditions, including traffic exposure, hazardous parking, animals, weather, poor lighting, or other risks. GlassPatch is not liable for resulting delays or inability to perform.
Force Majeure / Uncontrollable Conditions: GlassPatch is not responsible for delays, interruptions, or inability to perform Services due to events beyond our reasonable control, including weather, traffic conditions, road closures, emergencies, power outages, access restrictions, or other circumstances that make service unsafe or impractical.
9.Important Repair Disclosures (Results & Appearance Vary)
Windshield repair is a structural stabilization process, not a cosmetic restoration. Repairs do not guarantee improved clarity or appearance.
No Guarantee of Replacement Avoidance: GlassPatch does not guarantee that a repair will prevent future cracking or the need for windshield replacement.
Customer acknowledges that:
- In some cases, a repair may not visibly change the appearance of the damage
- Lack of cosmetic improvement does not mean the repair failed
- A repair can successfully restore structural integrity and prevent spreading even if the damage remains visible
- Visibility, clarity, and appearance vary based on glass type, impact angle, contamination, and existing stress
- All repairs carry inherent risk, and even properly performed repairs may spread or fail due to external factors
10.Payment Terms
GlassPatch does not require upfront payment for standard repair services. Before any repair begins, the Customer must sign a written or electronic Work Authorization and Release (“Authorization”).
By signing the Authorization, the Customer authorizes GlassPatch to perform the requested repair and agrees to pay the final price for all authorized services immediately upon completion of the repair. Once GlassPatch has completed the authorized repair, payment becomes immediately due and payable.
Failure to pay for completed, authorized services constitutes a breach of this Agreement. GlassPatch reserves all rights and remedies available under applicable law to recover unpaid amounts, including reasonable collection costs and attorneys’ fees where permitted by law.
If, after inspection or during setup, GlassPatch determines that a repair cannot be safely or reasonably performed, the Customer will not be charged for that repair. If any payment was collected in advance for any reason, it will be refunded immediately.
GlassPatch does not guarantee insurance coverage or reimbursement and does not act as an insurance adjuster.
11.Cancellations & Rescheduling
Appointments may be rescheduled by contacting us. Cancellations without reasonable notice may be subject to a cancellation or service-call fee, as disclosed during booking and permitted by law. Any applicable cancellation or service-call fees will be disclosed at the time of booking.
12.Refunds; Limited Remedy; 2-Month Warranty Period
Once a repair has been performed, all fees are non-refundable, except as expressly stated below.
If GlassPatch determines, in its reasonable discretion, that an eligible repair materially failed due to our workmanship, Customer’s sole and exclusive remedy is limited to one of the following, at GlassPatch’s option:
- One (1) re-attempt at repair (if feasible), or
- A refund of the original amount paid for the repair service only
Strict Time Limit: Any request must be made within two (2) months from the exact time the Completion Acknowledgment is signed after the repair. No remedies are available after this period.
Service-Only Warranty: Any warranty or remedy offered by GlassPatch covers the repair service only. It does not cover the windshield itself and does not include the cost of windshield replacement.
Chip Repairs Only: The only services eligible for warranty consideration are chip repairs. GlassPatch warranties chip repair services not only for workmanship, but also for normal external factors because that is the purpose of a chip repair and part of our base promise. We are confident a properly completed chip repair should hold up in real-world conditions.
No Crack Repair Warranty: Crack repairs are attempted stabilization only and have no warranty. All crack repair sales are final. This no-warranty term for crack repairs is also disclosed in the Authorization.
GlassPatch does not cover windshield replacement, glass parts, ADAS calibration, third-party repairs, rentals, towing, transportation, loss of use, lost wages, inconvenience, or diminished value.
13.Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE.” All warranties are disclaimed except where prohibited by law.
14.Limitation of Liability
To the maximum extent permitted by law, GlassPatch’s total liability for any claim shall not exceed the amount actually paid by Customer for the specific repair service giving rise to the claim.
GlassPatch shall not be liable for indirect, incidental, consequential, exemplary, or punitive damages.
15.Indemnification; Release
Customer agrees to indemnify and hold harmless GlassPatch LLC and its owners, employees, contractors, and agents from claims arising from misrepresentation, unsafe conditions, or violation of these Terms.
California residents waive California Civil Code Section 1542 to the extent permitted by law.
16.User Conduct
No harassment, abuse, fraud, false claims, or interference with staff or operations.
17.Text Messages & Electronic Communications
By providing a mobile number, Customer consents to receive service-related SMS/MMS messages. Message and data rates may apply. Consent is not a condition of purchase.
Opt-Out: You may opt out of SMS messages at any time by replying STOP.
18.Third-Party Sites
GlassPatch is not responsible for third-party websites or services.
19.Geographic Restrictions
Services are offered within selected service areas in California and the United States.
20.Limitation on Time to Bring Claims
Any claim must be brought within six (6) months of the payment date related to the service, to the extent permitted by law.
21.Dispute Resolution & Arbitration
Disputes must first be addressed informally for 30 days, then resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in California.
Arbitration Opt-Out: Customer may opt out of arbitration within thirty (30) days of first accepting these Terms by sending written notice to glasspatchnow@gmail.com.
22.Class Action Waiver
All disputes must be brought individually, not as class or representative actions.
23.Court Venue If Arbitration Is Unenforceable
Any court action must be brought exclusively in California state or federal courts.
24.Governing Law
These Terms are governed by the laws of the State of California.
25.Entire Agreement; Severability
These Terms constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect.
